Article 1 - Definitions
1.1 Entrepreneur: the general partnership Camping Domein Groot Besselink, established in Lage Lochemseweg 31c, 7218PA Almen.
1.2 Guest: the natural or legal person who enters into an agreement with the Entrepreneur regarding a stay at the campsite (pitch) or in a holiday accommodation (e.g. chalet, tiny house, lodge).
1.3 Fellow guest: any person staying at the campsite together with or at the invitation of the Guest.
1.4 Agreement: the agreement concluded between Entrepreneur and Guest regarding the rental of a pitch or holiday accommodation for recreational purposes.
1.5 Reservation amount: the total amount due under the Agreement, including additional costs and taxes.
1.6 Written: both written and electronic communication (e-mail, reservation systems).
1.7 Extreme weather conditions: weather phenomena over which the Entrepreneur has no influence (including, but not limited to, storm, lightning, hail, heavy rain, flooding, prolonged heat or cold).
1.8 Force Majeure: any circumstance beyond the control of the Entrepreneur as a result of which (further) compliance with the Agreement cannot reasonably be expected, including in any case – but not limited to – disruptions or interruptions in the supply of electricity, gas or water, fire, pandemics, government measures, strikes, natural disasters and evacuations.
Article 2 - Applicability
2.1 These General Terms and Conditions apply to all offers, reservations, Agreements and (further) accommodation transactions between Entrepreneur and Guest.
2.2 General (purchase) conditions of the Guest are expressly not applicable, unless the Entrepreneur has accepted them in writing.
2.3 In the event of any conflict between the Agreement and these General Terms and Conditions, the Agreement shall prevail, unless the Agreement expressly deviates from these terms and conditions in favor of the Guest.
Article 3 – Reservation and Payment
3.1 A reservation is made after the Entrepreneur has confirmed the request in writing.
3.2 Payment Schedule:
a) For reservations made ≤ 1 month (30 days) before arrival: 100% of the reservation amount must be paid within 48 hours of receipt of confirmation.
b) For bookings made > 1 month before arrival: 25% deposit within 48 hours*; the remainder (75%) no later than 1 month (30 days) before arrival.
*Terms start from the date of dispatch of the confirmation/invoice email.
3.3 If payment is not made on time, the Guest will be in default without further notice of default. The Entrepreneur will then have the right to terminate the Agreement and re-issue the place, without prejudice to the right to compensation for (collection) costs and statutory interest.
3.4 If the Entrepreneur is not in possession of the full amount due on the day of arrival, the Guest may be refused entry.
Article 4 – Cancellation by the Guest
4.1 Cancellations must be submitted in writing or by email.
4.2 Cancellation Fee (% of the Reservation Amount):
• Within 24 hours of booking: 0%
• Up to 56 days (inclusive) before arrival: 50%
• Less than 28 days before arrival: 100%
Article 5 – Arrival, Stay and Departure
5.1 Check-in:
• Holiday homes: from 15:00 PM
• Camping pitches: from 14:00 PM
5.2 Check-out:
• Holiday homes: no later than 10:00 am
• Camping pitches: no later than 11:00 am
5.3 Late arrival:
a) Arrival at the campsite with a vehicle is not permitted after 20:00 PM; the Entrepreneur may refuse access.
b) Guests of holiday homes arriving after 20pm can only enter the grounds on foot from the visitors' car park.
5.4 Early departure or arrival later than the reserved period does not entitle you to a refund.
Article 6 – Liability and Risk
6.1 The stay at the campsite and in the holiday homes is entirely at the own risk of the Guest and Fellow Guests.
6.2 The Entrepreneur is not liable for damage or injury as a result of (extreme) weather conditions, natural disasters, force majeure situations or failure/disruptions of utilities (electricity, water, gas, internet), unless there is intent or gross negligence on the part of the Entrepreneur.
6.3 The Entrepreneur is not liable for theft, loss or damage to the Guest's property, unless the damage is due to intent or gross negligence on the part of the Entrepreneur.
6.4 The Guest is liable for all damage to the property of the Entrepreneur or third parties caused by him or his Fellow Guests. Damage must be reported immediately and compensated on the spot.
Article 7 - Force majeure
7.1 In the event of Force Majeure, the Entrepreneur has the right to suspend, modify or terminate the performance of the Agreement without being liable for any compensation or refund.
7.2 If the Force Majeure lasts longer than 48 hours, the Entrepreneur will seek a reasonable solution in consultation with the Guest, such as moving the reservation to another date or issuing a voucher.
Article 8 – House Rules and Safety
8.1 Guests must adhere to the house rules and follow all instructions from the staff.
8.2 Open fires are not allowed, not even in the fire pit.
8.3 Pets are allowed on camping pitches, not in holiday homes. They must always be kept on a leash and may not cause any nuisance. Maximum 1 pet per spot.
8.4 It is prohibited to cause noise or noise nuisance between 22:30 and 07:00.
Article 9 – Complaints and Disputes
9.1 Complaints must first be reported on site and as soon as possible at reception, so that an appropriate solution can be found.
9.2 If a complaint is not resolved satisfactorily, the Guest can submit it in writing to the Entrepreneur within two months after departure.
9.3 All agreements are governed by Dutch law. All disputes arising from or related to the Agreement will be submitted to the competent court in to be determined, unless mandatory law designates another judge.
Article 10 – Final provisions
10.1 If one or more provisions of these General Terms and Conditions are null and void or are annulled, the remaining provisions shall remain fully in force. The invalid part shall be replaced as much as possible by a provision that approximates the intention of the original article.
10.2 The Entrepreneur is entitled to amend these General Terms and Conditions. The amended terms and conditions will enter into force at the time of publication on the website, unless stated otherwise.
